1. Service Description

SiteCheckup ("the Service") is a web-based tool that audits websites for SEO, accessibility, security, performance, and other quality factors. The Service is operated by SiteCheckup ("we", "us", "our").

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

3. Accounts

You may need to create an account to access certain features. You are responsible for maintaining the security of your account credentials and for all activity under your account. You must provide accurate information when creating an account.

4. Subscriptions and Billing

Paid plans are billed on a monthly or annual basis. All payments are processed by Paddle.com Market Limited ("Paddle"), who acts as the Merchant of Record for all transactions. Paddle handles all payment processing, invoicing, sales tax, and VAT. By subscribing to a paid plan, you also agree to Paddle's terms of service.

Subscription fees are charged in advance for each billing period. You may cancel your subscription at any time, and cancellation will take effect at the end of your current billing period.

5. Refund Policy

If you are unsatisfied with the Service, you may request a refund within 14 days of your initial purchase. Refund requests should be sent to sitecheckup@gregoiregeoffroy.com. Refunds are processed through Paddle.

6. Free Tier

The free tier includes up to 5 audits per calendar month. We reserve the right to modify free tier limits at any time. Free tier usage is subject to rate limiting and fair use policies.

7. Acceptable Use

You agree not to use the Service to:

• Scan websites you do not own or have authorization to audit
• Conduct denial-of-service attacks or overload target servers
• Attempt to exploit vulnerabilities discovered through audits
• Resell or redistribute audit results without authorization
• Circumvent usage limits or rate limiting mechanisms
• Violate any applicable laws or regulations

8. Intellectual Property

The Service, including its code, design, and content, is owned by SiteCheckup and protected by intellectual property laws. Audit reports generated by the Service may be used freely by the account holder for their own purposes.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We are not responsible for the accuracy of audit results or any actions taken based on those results. In no event shall SiteCheckup be liable for any indirect, incidental, special, consequential, or punitive damages.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We may update these terms from time to time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated terms.
